Scott McKeown is an undisputed leader in the post-grant space and a lawyer whom many would put in their top five PTAB attorneys. He has handled more than 300 inter partes reviews and other AIA proceedings since 2012 and in recent years has achieved many notable wins.
Scott McKeown is a partner in Ropes & Gray’s IP litigation practice group and chair of the firm’s PTAB practice. He focuses his practice on post-grant patent counselling and litigation matters at the USPTO and related appeals to the US Court of Appeals for the Federal Circuit. Mr McKeown has extensive experience handling all aspects of post-issuance patent proceedings, specialising in administrative trials before the PTAB, such as inter partes review and post-grant review. He also provides advice on USPTO post-grant proceedings concurrent with complex International Trade Commission and district court litigations. Mr McKeown is one of the most active PTAB trial attorneys in the United States, having handled more than 350 PTAB matters since 2012. In recent analysis by Managing IP, Mr McKeown was recognised as the second most active PTAB practitioner in 2020. He has also handled some of the most noteworthy PTAB trials to date, including successfully navigating the first (and one of only two such cases) inter partes review petitions that included live testimony.
Mr McKeown is recognised as a thought leader in post-grant patent practice in the United States. He is a professorial lecturer in law at George Washington University Law School. He is frequently quoted in the press on PTAB and post-grant patent issues, including Reuters, Bloomberg Law and the Wall Street Journal. Mr McKeown also publishes the award-winning legal blog, PatentsPostGrant.com. He is a founding member of the PTAB Bar Association and is the only two-time winner of IAM’s PTAB Litigator of the Year. IAM Strategy 300 has said that Mr McKeown is not just a PTAB practitioner, but is “incredibly knowledgeable about all things even tangentially relevant to patents”. As Chambers USA reports from a client, “Scott is probably the most well-known PTAB specialist. He is very efficient and knows the PTAB and its procedures, inside and out”.
