Bronze - Individuals: litigation

Boasting over 120 years on the market, Simmons & Simmons is one of only a handful of UK firms capable of offering end-to-end patent coverage, from prosecution through litigation to commercialisation and transactions. The outfit prides itself on its in-depth expertise in technology and the life sciences, and the majority of its practitioners across every practice area have technical backgrounds. The head of the IP group, Michael Gavey, is a specialist in IP-heavy transactions, especially for life science companies. One of his high-profile clients is UK charity the Institute of Cancer Research, which he advises on licensing and collaboration arrangements. Lydia Torne is another specialist in life science transactions, as well as the associated regulatory compliance issues. One company Torne advises on various strategic licensing deals is Genmab, including on 14 antibody products with potential for treating cancers and Parkinson’s disease. The transactional expert taking up the tech side of Simmons & Simmons’ practice is Angus McLean. One deal he advised on last year was for EV Technology Group on its multi-million-pound acquisition of UK-made automotive brand MOKE International. On the contentious side, Priya Nagpal also takes on high-tech patent clients. For nearly 20 years Nagpal has advised on complex, multi-jurisdictional tech disputes, across software, big data and medical devices. She has been particularly busy defending Boston Scientific in two non-disclosable litigations. Other top litigators at the firm include Michael Burdon, Andrew Hutchinson, Kevin Mooney and Scott Parker, all of whom are particularly skilled in the life sciences sector, with Burdon supplementing on the tech side, including medical devices. A big project for him was coordinating the defence for Xiaomi in five different countries against a SEP/FRAND litigation brought by Philips. The two parties reached a settlement in 2022. Hutchinson has been involved in pharma and biotech patent cases for over 10 years; in 2023 he will act for Bayer in an appeal against revocation proceedings brought by Teva. The widely respected Mooney is among the only UK solicitors to act as a member of the expert group advising on UPC implementation. Parker coordinated a vast, highly complex, multi-jurisdictional patent litigation for UCB against first Genentech and then Novartis. The case has since settled. On the prosecution front, the team’s expertise in the life sciences remains evident. Frederick Nicolle is another life sciences specialist, with particular acumen in offering expert assistance during complex litigation proceedings. Kevin Cordina supplements on the tech side, making him well equipped for medical device companies.
