Turkey’s practitioners remain resilient and strong, following a difficult year for the country, which saw violent acts and natural disasters. The Turkish Patent and Trademark Office (TPTO) has achieved steady growth in domestic patent filings, and at the end of 2022 domestic applications had exceeded foreign applications for the first time since 1994. As the region continues to cement itself as an attractive choice for universities, inventors and multinational companies, the TPTO seeks to become more in line with European systems. When it comes to the Unified Patent Court (UPC), local advisers have identified several concerns related to implementation, and there is ambiguity regarding how the UPC will be received by nations like Turkey that are not members of the UPC or the European Union – especially when it comes to invalidation proceedings. While practitioners question how national invalidation actions will operate in conjunction with the European Patent Office and the UPC, the impact remains to be seen.
