The Legislative Yuan passed a draft amendment to the IP Case Adjudication Act in January 2023, which includes some sizeable changes to the existing practice. First, the majority of civil IP disputes will mandatorily require legal representation. Also, the IP court will have exclusive jurisdiction in relation to trade secrets infringement – in particular state-level key technologies. Another key change concerns the expert witness system. It has now officially been introduced into the amendment, which is similar to current US practice. The alterations would also allow the court to designate a neutral technical expert to verify any evidence on request. It is worth noting that some proposed changes have not been included in the passed amendment. Therefore, the bill is expected to be revisited by the Legislative Yuan in the foreseeable future for further changes.
