Ranking 20th in the world for the number of international patent applications filed, the Spanish IP scene is as vibrant as ever – local inventors continue to develop new and exciting inventions and clearly recognise the importance of global protection. With the arrival of the Unified Patent Court (UPC) in the summer of 2023, Spain’s rejection of this court continues to be a topic of debate and has staunchly divided opinions among practitioners. However, it is widely agreed that the introduction of the UPC will pose new challenges and opportunities for rights holders, which has sparked the need for new and unique strategies to ensure that Spanish companies can capitalise on opportunities. On the legislative side, the Spanish government approved a draft bill to reform the Trademark Law, the Industrial Design Law, and the Patent Law in 2022 so changes to the patent landscape are expected.
