The revisions to South Korea’s Patent Act came into effect on 20 April 2022. They introduced a slew of notable changes, among which is the extension from 30 to 90 days of the appeal period to a final rejection. There is also the possibility to request re-examination after receiving the notice of allowance. A new, separate application system has also been introduced for any application filed after 20 April 2022. Today, single claims considered admissible after appeal to the final rejection can be split and filed separately. Finally, the requirements to re-establish lapsed patent rights have also been relaxed. Now, any patentee with a justifiable reason will be able to take action to restore their rights. In other news, the country ranked fourth in Patent Cooperation Treaty 2022 filings according to WIPO. In the latest edition of the Global Innovation Index by the same organisation, South Korea ranked sixth, preceded only by Switzerland, Sweden, Netherlands, the United States and the United Kingdom.
