The IP scene in Italy is undeniably vibrant, and the market is abuzz with one storyline in particular – the Unified Patent Court (UPC). In late 2021 the ratifications of the UPC Agreement by several EU member states meant that the last preparations for launch could finally begin. However, one major consideration here is the long-term fate of the life sciences section of the central division of the UPC court of first instance – originally earmarked for London before the United Kingdom decided not to participate in the UPC – which is yet to be determined. A vast majority of professionals consider Milan to be the likely destination, due to its economy and the prominence of life sciences litigation in the country more generally. That said, if Milan does take London’s place, the new opportunities for local practitioners and clients could be endless. On the non-contentious front, patenting activity has remained healthy across a wide range of industries, and the country’s patent office reported an increase in applications received in the past year.
