While Austria’s IP scene has predominantly remained stable, all eyes are on the developments concerning the European Union’s Unified Patent Court (UPC). Austria was the first EU member state to ratify the UPC in 2013 and, with the new court system firmly back on track, the country has since accepted the PAP-protocol (Protocol to the UPC Agreement on Provisional Application). This will now enable the UPC’s final preliminary steps to take place, which includes agenda items such as the selection of judges. These steps are expected to span eight months, with rumours circulating that the new court system could be operational by the end of 2022. In the meantime, the country’s practitioners have plenty of work to keep them busy, with pharmaceutical and digital mandates continuing to take centre stage.
