The IP scene in Austria remains stable, with the most recent headlines relating to the European Union’s Unified Patent Court (UPC). The Protocol to the Agreement on a UPC on Provisional Application (the PPA-protocol) was ratified in January 2022, allowing the remaining preliminary steps to be completed, and since then the Vienna local division has been established. Everything is in place for the UPC to go live in June 2023 and, in the meantime, the country’s practitioners continue to enjoy a steady litigation workload.
