Thomas Wimbiscus’ many years of success in litigating IP cases in the US courts, the US International Trade Commission and the PTAB has led clients to trust him with their most important IP disputes. With 30 years of experience, he has appeared in more than 100 litigations and more than 100 inter partes reviews (IPRs). He is one of the 10 most active IPR practitioners in the US for patent owners (Patexia 2018).
Mr Wimbiscus has been recognised as one of the world’s leading patent professionals by publications such as the IAM Patent 1000 (2018 and 2019), the Top 500 Leading Lawyers Across the Globe by Intercontinental Finance & Law, the Top 100 Lawyers for 2016/17 by ‘LegalComprehensive.com’, Practical Law Company (PLC Global Counsel 3000, Choose Your Counsel Wisely) Practical Law Company’s Cross-Border Handbook and the Leading Lawyers network.
Mr Wimbiscus was inducted as a fellow of the Litigation Counsel of America (LCA). The LCA is a trial lawyer honorary society composed of less than one-half of 1% of American attorneys – based on effectiveness and accomplishments in both litigation and trial work.
His litigation successes include numerous multi-million dollar awards and settlements, as well as patent infringement defence victories throughout the US as well as in the US International Trade Commission.
Mr Wimbiscus has served as trial counsel in a four-week jury trial resulting in a patent infringement award of more than $80 million with a finding of wilful infringement (reversed in part and remanded); multiple patent litigations on behalf of Broadcom in Broadcom Corp v Qualcomm, Inc (global campaign settlement of $891 million); numerous trademark litigation victories on behalf of Ashley Furniture Industries, Inc and other parties; and numerous other plaintiff and defence victories involving a wide array of technologies.
