E Anthony Figg specialises in IP law, primarily involving the chemical, pharmaceutical, healthcare and biotechnology industries. His practice focuses on patent litigation and interferences, re-examinations, patent procurement, IP licensing and related contract matters, opinions and counselling.
He has been lead counsel in numerous complex patent litigations in federal district courts, the International Trade Commission and the Board of Patent Appeals and Interferences; and in appeals before the US Court of Appeals for the Federal Circuit and the US Court of Appeals for the District of Columbia Circuit.
Mr Figg litigated early cases arising from the Drug Price Competition and Patent Term Restoration Act of 1984 (Hatch-Waxman) and still handles many such cases. His trial and appellate practice includes the successful prosecution of groundbreaking cases involving the interpretation and application of the Hatch-Waxman amendments.
He holds a JD from Indiana University School of Law (1973) and a BS in chemistry from Rose Polytechnic Institute (1968). He is admitted to the Bar in the District of Columbia and the US Patent and Trademark Office. His court admissions include the US Court of Appeals for the Federal Circuit, the US Court of Appeals for the District of Columbia Circuit and the Supreme Court.
He is a fellow of the American College of Trial Lawyers and the American Bar Foundation.
Mr Figg has been included annually in the Washington DC Super Lawyers list since 2007. He has been selected as a leading attorney by The Best Lawyers in America© since 2008 and the publication named him Lawyer of the Year in Washington DC for IP litigation in 2018, for patent litigation in 2013 and for IP law in 2011.
Mr Figg is a member and past chair of the American Bar Association’s IP Section. He served on the council of that organisation and has chaired several of its committees and taskforces over the years. He is a member of the District of Columbia Bar’s IP Law Section and the Licensing Executives Society.
