Cyrus A Morton is a trial attorney whose complex litigation practice has included an emphasis on patent litigation, including plaintiff side monetisation and licensing, defence work and PTAB cases.
Mr Morton has litigated and won cases across the technology spectrum for companies such as Polaris, Toro, Medtronic, Draeger and Ingersoll-Rand, including their brands Club Car, Thermo-King and Trane. His representation has led to numerous trial successes, including an $89 million judgment against Clear Channel, a $12 million judgment against Apple and a $7.4 million judgment against Itron. He has also led successful licensing campaigns outside of the courtroom, collecting an aggregate $35 million for a technology company from automobile and cell phone manufacturers.
Mr Morton is also the chair of Robins Kaplan’s patent office trials group, which focuses on the new procedures for patent office trials on patent validity or derivation created by the America Invents Act. Mr Morton has been lead counsel in over 100 post-grant proceedings. To date, he is the only attorney in the country to have handled matters in all four proceedings including derivations, covered business method, post-grant review and inter partes review proceedings.
Prior to becoming a lawyer, Mr Morton saw the patent system from the inventor’s side. While working at 3M Company he co-authored three records of invention and was a named inventor on US Patent No 5,858,624, titled “Method for assembling planarization and indium-tin-oxide layer on a liquid crystal display color filter with a transfer process”.
Mr Morton’s work has earned recognition from numerous organisations. He has been named an “Intellectual Property Trailblazer” by The National Law Journal, a “Top Attorney in the PTAB” by Docket Navigator and a “Minnesota Super Lawyer” by Super Lawyers. He has also been included on the list of “Best Lawyers in America”.
