Carla S Mulhern specialises in the application of economic principles to issues arising in complex business litigation and has substantial experience in IP matters. Ms Mulhern has assisted clients in a variety of industries, including pharmaceuticals, medical devices, automotive, entertainment, consumer products, computer hardware and software and semiconductors.
Ms Mulhern has provided expert witness testimony in district and state courts, before arbitration panels and before the International Trade Commission (ITC). Her testimony has included the analysis of commercial success and of damages arising from allegations of the misappropriation of intellectual property and breach of contract. At the ITC, she has testified on economic issues related to commercial success, domestic industry, remedy, bond and public interest. Ms Mulhern’s IP damages experience includes cases involving allegations of patent, copyright and trademark infringement, as well as misappropriation of trade secrets.
Ms Mulhern has assisted clients in all aspects of litigation, including development and review of pre-trial discovery, development of economic and financial models to analyse damages, critique of analyses propounded by opposing experts and preparation of testimony. In non-litigation matters, Ms Mulhern has conducted valuations of intellectual property in the context of prospective licensing negotiations, strategic alliances and joint ventures.
A frequent writer and speaker on issues related to IP valuation and damages assessment, Ms Mulhern has co-authored articles published in outlets such as Law360 and The Licensing Journal.
Ms Mulhern holds an MSc in economics (London School of Economics and Political Science) and a BS in mathematics (Bucknell University).
