C Graham Gerst’s broad IP experience includes testifying and speaking on patent monetisation before Congress, the Federal Trade Commission and the Department of Justice, as well as serving as an expert witness.
Mr Gerst counsels clients in a wide array of IP matters. He represents clients in litigation in the district courts and before the US International Trade Commission, as well as working with clients to license their intellectual property without resorting to the courts. He also sells patents and trade secrets for his clients and achieved possibly the highest per-family price ever paid in the industry ($37.5 million). Based on his successes in patent monetisation, Mr Gerst often advises on a variety of financial interests considering investments in patent assets and patent enforcement.
Before joining Global IP, Mr Gerst swas senior counsel to the deputy attorney general at the Department of Justice, where he vice chaired the department’s IP taskforce and was appointed deputy US coordinator for international IP enforcement. He also managed technology-related and national security issues for the deputy attorney general (including computer forensics, information sharing, biometric data collection and management) and the department’s participation in the Committee on Foreign Investment in the United States – the body that reviews foreign acquisitions of US technology for national security concerns. Mr Gerst also was appointed special assistant US attorney in the District of Columbia and was lead counsel on multiple successful criminal jury trials. Before that, Mr Gerst spent nine years in the IP litigation group at Kirkland & Ellis LLP, where he was a partner.
Mr Gerst received a JD (cum laude) from the University of Chicago Law School, where he was an editor of the University of Chicago Law Review and subsequently lectured on trial advocacy. He is admitted to the bars of the US Supreme Court, the US Courts of Appeals for the Federal, Fifth and Seventh Circuits and the trial bar of the US District Court for the Northern District of Illinois.
