How the Chinese Supreme Court looks at jurisdiction in SEP cases

The news this week that the Wuhan Intermediate People’s Court had issued a broad anti-suit injunction against InterDigital proves that Chinese courts are willing to set global FRAND rates. As in other jurisdictions, judges in China are also taking strong steps to try to ensure that they get a chance to rule on cases that they take up. As courts around China look to assert their jurisdiction and issue anti-suit orders, there are two key Supreme People’s Court (SPC) decisions they will look to for guidance.
