Richard J Stark is a partner in Cravath’s litigation department. His practice emphasises intellectual property, antitrust and other technologically intensive litigation for both plaintiffs and defendants.

Mr Stark is representing Qualcomm Incorporated in a number of US and international matters relating to Qualcomm’s patent licensing and modem chipset businesses, including in litigation filed by Apple. He recently advised Qualcomm on patent infringement and competition litigations in China against Meizu. Mr Stark is also representing in patent infringement litigation brought by Vivint related to’s interactive security and home automation technology. He has won two inter partes review decisions after hearings before the Patent Trial and Appeal Board (PTAB), which invalidated 85 claims with respect to two of Vivint’s patents, and succeeded in invalidating 31 claims of three more of Vivint’s patents in additional PTAB decisions.

Mr Stark was lead counsel for IBM in a case brought against Neon Enterprise Software in federal court in Austin, Texas involving antitrust, licensing, business torts and copyright claims. IBM won a permanent injunction against Neon’s zPrime software and dismissal of all Neon’s claims. He also served as co-lead counsel for plaintiff Sanofi in the enforcement of the patent on the active ingredient in Plavix®, securing a final judgment of $442 million and a permanent injunction.

Mr Stark has been recognised as a leading IP practitioner by numerous professional publications, including The Legal 500, Lawdragon, US News & World Report – Best Lawyers and the Leaders League Innovation – Technology & Intellectual Property Report. He is chair of the Committee on Intersection of IP and Antitrust Law of the American Bar Association (ABA) Section of Intellectual Property Law. He has also been co-chair of the 101 Subcommittee of the ABA IP Law Section’s Patent Litigation Committee.

Mr Stark received an AB from Harvard College in 1986, with a dual focus on government and computer science, a JD from New York University School of Law in 1991 and an MS in computer science from Columbia University in 2014.
