With three partners dedicated mainly to patent litigation, Westerberg & Partners has one of the largest patent litigation teams in Sweden. Their experience includes acting in most, if not all, industry sectors, with particular experience in the biotechnology, pharmaceutical and life sciences fields, acting before the Swedish courts, as well as advising in opposition proceedings before the Swedish Patent Office and the EPO.
Clients are predominantly large international corporations. The team is thus used to working in pan-European and global patent disputes, instructing or taking instructions from firms in other jurisdictions, and quickly reading up on new cases and technical areas, with assistance from a network of experienced patent engineers if required.
Contracts and transactions
Three of the firm’s partners focus on contractual and transactional work within IP-focused and regulated industries. Their experience ranges from working for well-established publicly traded companies in complex transactions and collaborations, to assisting start-ups in commercialising intellectual assets and bringing products to market. The team represents/advises clients from most industry sectors, with a notable number of clients from the pharmaceutical and medical device industries, as well as the pulp and paper and steel industries. In addition, the team represents several high-profile clients in the media and fashion business.
Non-contentious IP work comprises the drafting and negotiation of licences and related commercialisation agreements, as well as strategic advice for commercialisation and exploitation of all aspects of intellectual assets such as intellectual property, know-how and regulatory rights. Work highlights include acting for several originator pharmaceutical companies in tri-party negotiations with the Swedish Dental and Pharmaceutical Benefits Agency regarding pricing of pharmaceutical products, and the development of complex template agreements for multi-party collaborations for research and innovation.
Marketing and regulatory
Closely tied to and often highly relevant in patent matters, the firm has significant experience in marketing and regulatory law, in particular in heavily regulated industries such as the pharmaceutical, healthcare, gambling, medical devices, alcoholic beverages and tobacco industries. In the life sciences sector, the team has considerable experience advising on the ethical guidelines governing pharmaceutical companies. They are also regularly retained for work in developing fields, such as e-cigarettes, cannabidiol (CBD) and others.
In contentious marketing and regulatory matters, the firm regularly represents clients before administrative courts and in proceedings before government authorities such as the Swedish Medical Products Agency and the Swedish Gambling Authority.
