We represented MTG Co Ltd in MTG Co Ltd v Shenzhen Hengjianda Technology Co Ltd where we emphasised the significant influence of the design feature of the infringed patent compared to the existing designs. We thus persuaded the second-instance court to revoke the first-instance judgment, and established infringement. Further, we proved the defendant’s infringement profit based on data gathered from an e-commerce platform, and the court ordered the defendant to disclose its accounting information. Our claim was fully supported, and our client received significant compensation which was higher than the statutory compensation amount.
We also represented Bridgestone Corporation in Bridgestone Corporation v Zhejiang Hang Ting Dun Bull Rubber Co Ltd. The Supreme People’s Court issued a final judgment in retrial that reversed the first and second-instance rulings, deciding that the defendant must cease the production and sale of the infringing tyre. The court also ordered Bull Company to destroy the model and stock of the tyre and pay damages to Bridgestone.
