The firm is active in patent prosecution. Each year, HOFFMANN EITLE files more than 4,000 new patent applications for its clients. With over 90 qualified European patent attorneys with a variety of technical backgrounds, it can provide competent advice in all technical areas, from aeronautics to zoology.
HOFFMANN EITLE is the market leader in European Patent Office opposition work, being involved in over 5% of opposition cases. This is significantly more than any other law firm in Europe. This opposition experience is valuable when prosecuting patent applications carefully, to ensure that the resulting IP rights have real value and can withstand challenge from competitors.
The firm is also active in patent litigation, both in the coordination of multi-jurisdictional disputes and in proceedings at the German courts. In German patent litigation, parties are typically represented by a patent attorney and an attorney at law. While most firms only have one or the other, HOFFMANN EITLE has 11 attorneys at law who work with our patent attorneys on litigation projects.
HOFFMANN EITLE’s German litigation experience, on both the attorney at law side and the patent attorney side, places the firm in a strong position to conduct litigation in the Unified Patent Court, once this exciting new court system comes into effect. In this area, HOFFMANN EITLE is a thought leader – frequently presenting on the topic and also publishing a book about it.
Our litigation and licensing team also provides advice on IP-related issues, such as competition law, contract law and licensing.
Trademark and design work is another active area in the firm, both in prosecution and litigation. The firm has 10 attorneys at law with specialist trademark knowledge.
The firm is multinational, featuring European patent attorneys from many countries, including Germany, the United Kingdom, France, Spain, Italy, Ireland, Austria, the Netherlands, Belgium and Denmark. This enables the firm to advise clients in many languages and provides an understanding of legal traditions and a network of contacts in their respective countries.
Additionally, the firm has European patent attorneys from a number of countries outside Europe, including the United States, Japan and China. The firm has patent advisers from Korea, who are working towards qualification in Europe. These attorneys and advisers can act as a bridge between the firm and clients in their home countries, combining their knowledge of the European IP systems with their understanding of local language, culture and traditions in their home countries. For example, in 2016 the firm published a comprehensive book on European patent law in Japanese.
