The patent holder can send a warning letterand seek an out-of-court settlement withthe alleged infringer. A successful warningletter is the most effective way to enforcerights, since it is subject to no formalitiesand costs little. If no solution can be foundin this way or through arbitration ormediation (to which the alleged infringermust agree), the patent holder has nooption other than to enforce its patentthrough a court action.
