A patent holder can send a warning letterand seek an out-of-court settlement with analleged infringer. A successful warning letter isthe most effective way to enforce rights, sinceit is subject to no formalities and costs little. If no solution can be found in this way, orthrough arbitration or mediation (to which thealleged infringer must agree), the patent holderhas no option other than to enforce its patentthrough a court action.
