To enforce its rights, a European patent holdercan choose between applying for a finalinjunctive order or an interlocutory order. Thesame court will normally be competent todecide both cases since, asa rule, the court where the defendant hasits place of business is the legal venue foreither action. Under the new Civil Disputes Act,in ordinary actions the district court will hearthe case within six months of the date onwhich the action was commenced andwill return a judgment within two to four weeksof the hearing. Interlocutory injunction actionsmay be expected to move faster,but in most patent cases a ruling will notbe obtained earlier than four to eight weeksafter the petition is filed with the court.
