Poland

The Polish patent market is in fine shape, despite the country’s rejection of the proposed unitary patent system. While it still lacks specialised IP courts – making the results of disputes harder to predict – commentators have recently acknowledged an improvement in the quality of decisions, partly thanks to an increased appreciation of intellectual property among the judiciary. As the largest economy in Central Europe and the sixth largest in the European Union, Poland remains a crucial location for foreign investors and international patent owners; the domestic IP scene also continues to thrive. While Polish trademark law saw some significant revisions in 2016, the patent market remains characterised by stability and a pervasive sense of optimism.

Allen & Overy casts a long shadow on the European patent landscape, with standout practitioners stationed across the continent, including in the United Kingdom, France and Germany. Its Polish practice was thrust into the limelight in late 2015 with the hire of patent dignitary Krystyna Szczepanowska-Kozłowska, “one of the most renowned and successful names on the market”. She has the Midas touch, having brought in a slew of world-leading rights holders to the firm, which she defends in ground-breaking suits on a daily basis. “She merges legal knowledge with a very valuable scientific background and this enables her to act on behalf of the largest pharmaceutical companies in the world.” As one peer avers: “Szczepanowska-Kozłowska is a pleasure to work with and her gold-tier ranking is a perfect reflection of her skill.” She and her team specialise in precedent-setting cross-border litigation, but have also recently been overseeing a plethora of cases concerning supplementary protection certificates (SPCs).
Bird & Bird Szepietowski i wspólnicy spk
International IP titan Bird & Bird is a fierce contender in the local patent market. Leveraging on the firm’s global might, the Polish contingent relishes high-stakes disputes that stretch across borders; however, it also attracts a substantial share of domestic cases. This can be attributed to the team’s all-encompassing understanding of IP law and close ties with the Polish patent office. Industries with an emphasis on innovation – such as life sciences and telecommunications – are focal points for the group. Newly minted partner Piotr Dynowski captains the IP unit. As a longstanding lecturer, he has a solid grasp of IP theory and practice; he has also recorded a number of crucial wins in the courtroom, which have sharpened his pragmatic outlook.
DLA Piper Wiater spk
Although already proficient across the entire IP spectrum, DLA Piper’s IP practice received a shot in the arm last year with several new additions and an organisational shake-up. She is an invaluable legal resource for all types of enforcement-related issues and one of the most qualified and hardworking IP attorneys out there”. Supported by DLA Piper’s global patent group network, she leads a squad of business-savvy practitioners who are particularly adroit in the pharmaceuticals arena, although of late high-technology has become another happy hunting ground.
