Poland

Optimism reigns on the Polish IP scene. Although the nation is not a signatory to the Unified Patent Court Agreement, it remains the sixth largest market in Europe for patent litigation and many indicators suggest that its prominence on the contentious front will only increase further. Some bemoan the relatively low regard given to intellectual property in the country’s collective commercial consciousness; but as the most important economy in Central and Eastern Europe, Poland is expected to see growing demand for knowledgeable patent practitioners. EU initiatives have also caused domestic filings to soar. All in all, the prospects look bright for the nation’s respected cadre of prosecutors and litigators.

Allen & Overy A Pędzich Spk
Companies embroiled in the most complex patent disputes and transactions regularly turn to legal behemoth Allen & Overy, which also carries out patent portfolio and freedom-to-operate reviews in the fastest-moving areas of technology. The set smashed it out of the park with the shrewd hire of innovative pharmaceuticals buff Krystyna Szczepanowska-Kozłowska and her team in late 2015. A superstar litigator, she is “the leading authority” on patents in the country. Having tackled a broad range of IP and business disputes – including briefs on financial operations and unfair competition – she has a holistic understanding of how best to navigate the thorniest cases. Lately, she turned her hand to a potentially precedential dispute involving supplementary protection certificates, while also playing a key role for a major drug company in Poland’s first-known case regarding dosage regime patents.
Bird & Bird Maciej Gawronski spk
Particularly well known for patents in Poland, the local outpost of global ensemble Bird & Bird handles over 30% of all domestic patent disputes. It has unique experience in the pharmaceuticals, chemicals and electronics spheres; in 2014, it secured victory in the highest-value patent nullity case in the nation’s history, in a matter concerning oral contraceptives. A true one-stop shop, it manages briefs across the entire patent lifecycle with consummate poise. Piotr Dynowski helms the able squad. A smooth operator, he communicates succinctly with clients and routinely wows in court. He recently assisted leading chemical company PCC in developing a global strategy to protect manufacturing technology for pure monochloroacetic acid. Aside from his robust patent practice, he can also advise on unfair competition and trademark matters.
DLA Piper Wiater spk
With a well-manned, dedicated IP department and significant bench strength, the Warsaw DLA Piper outfit effortlessly builds strong relationships with multinationals. The team suffered a blow when Krystyna Szczepanowska-Kozłowska moved to Allen & Overy; but clients – which include some of the world’s most discerning drugs companies – remain ably served by Justyna Wilczyńska-Baraniak. Well versed in multi-jurisdictional infringement proceedings, she is an erudite and methodical practitioner and a celebrated academic. She has been credited with establishing a healthy IT, e-commerce and cloud computing practice.

The internationally renowned operator has a well-balanced team of patent attorneys, lawyers and technical specialists who can advise on issues in English, German, French and Russian. It thus comes as no surprise that countless multinationals flock to it with inbound instructions. Although it has sustained losses lately with the departures of Katarzyna Karcz and Lech Bury, it remains a driving force in the field.
