The introduction of the specialised Patent and Market Court in late 2016 brought hopes of an improvement in both the speed and quality of decision making in IP infringement cases; while it is still early days, reflecting on 2017 practitioners feel that Sweden has already become a more attractive jurisdiction for patent litigation. Looking at 2018, Sweden has good economic growth prospects – the best of any Scandinavian country – which has put patent professionals in a positive frame of mind; a start-up boom in the financial technology and clean technology industries is just one thing contributing to the market’s dynamism. Uncertainty regarding the entry into force of the Unified Patent Court is, on the other hand, a cause of consternation, particularly as Sweden is set to be home to a regional division of the court.
