Israel

Israel is home to one of the world’s most dynamic start-up scenes, which has been fuelling a significant uptick in patent filings, especially in the cybersecurity space. On the contentious side, pharmaceutical litigation continues apace, with some of the world’s biggest multinationals locking horns to protect their rights in this lucrative market. In January 2017 the Israel Patent Office (ILPO) published the results of an extensive study into pre-grant opposition proceedings; the Ministry of Justice subsequently called for the relevant legislation to be overhauled, which is expected to happen in the near future.

Adin-Liss Law Offices
The worldly wise practitioners at Adin-Liss deploy their encyclopaedic patent knowledge to superb effect, especially when disputes arise. They consistently put in towering performances in Israeli courtrooms, while their silky negotiation skills ensure that costly battles can be avoided when this is in clients’ best long-term interests. Affiliated with business law firm Sharir Shiv & Co, it also has plenty of commercial nous to tap on complex transactions. Hailed for their razor-sharp minds and comprehensive patent know-how, Dan Adin and Eran Liss co-wrote key textbook Intellectual Property Law and Practice in Israel. Adin is intimately familiar with the workings of the ILPO; while a stint in-house for an international internet company has made Liss particularly popular with entities in the digital realm.
Dr Shlomo Cohen & Co
Dr Shlomo Cohen & Co commands immense respect on the Israeli patent scene. While it was hit by the high-profile loss of Liad Whatstein in 2016, it still has an enduring reputation – as borne out by the slew of Fortune 500 companies on its roster. This is in no small part due to the star power of name partner Shlomo Cohen, “an extremely experienced, hardworking patent litigator and still one of the country’s big names”. His credentials speak for themselves: he has served as president of the Israeli Bar Association, taught in universities at home and abroad, published extensively and, most importantly, secured any number of dazzling wins in court. He is ably supported by 14 practitioners who collectively can handle the full range of patent matters, including plant variety, licensing and franchising issues. The “robust patent prosecution practice” at Ehrlich & Fenster “advises a number of big clients in the life sciences sector and knows how to secure original inventions”. With a resolutely international outlook, it is a favourite of clients with ambitions of international expansion; it files about 900 applications in the United States alone each year and has an enviable allowance rate, thanks to its sure command of US IP law. Yissum Research Development Company of the Hebrew University and Ramot at Tel Aviv University – both among the top 100 worldwide universities granted US utility patents – are just two recent satisfied ustomers. Having carved out a real niche for itself in the education field, it also represents Arieal-University Research and Development Company and Yeda Research and Development. Paul Fenster leads from the front with a combination of high-level R&D expertise – thanks to extensive spells in industry – prosecution prowess and noteworthy contentious experience; he recently demonstrated his flair for oppositions, assisting Utilight in a matter against Orbotech. Amit Ehrlich consistently extracts maximum value from patent portfolios; he has brokered patent sale negotiations for individual inventors as well as major corporations and founded IPTrade, a business platform that centres on the effective monetisation of patents. Managing director Gal Ehrlich is a tech savvy practitioner with a PhD in genetic engineering and keen commercial acumen; he has drafted and prosecuted more than 1,000 patent applications in his career. Maier Fenster and Roy Melzer both make their IAM Patent 1000 debut this year. “Fenster challenges you not to think conventionally. He’s a super-smart guy who asks tough questions that put you to the test. He’s certainly one of the most knowledgeable and innovative practitioners around. Having looked at an issue, he will identify the key strengths and weaknesses of a position within minutes, and then formulate a sound strategy on that basis.” “A leading figure in software patents”, Melzer “combines creativity, practicality and strategic thinking to help build strong IP portfolios. More than that, he’s a trusted adviser and long-term thinker whom clients can trust to provide common-sense advice. Plus, he’s cost effective. While many patent attorneys lack the ability to envision how an underlying invention will work in the marketplace, and therefore overcome obstacles, Roy is an exception to the rule”. “The team at G&A Glazberg is responsive, cost effective and versatile; it provides strong support on litigation and commercial matters, as well as on prosecution and portfolio development.” The boutique is best known for its activity in the employee service inventions space, having been involved in seven such cases since – 2010 two of which went all the way to the country’s highest court. One recent example was its representation of Gideon Barazani against former employer ISCAR; in handing down its decision, the High Court of Justice called for new legislation in the field and for the right of employees to benefit from compensation for their inventions. The suit was masterminded by name partners Ziv Glazberg and Nadav Applebaum, who have also been racking up successes for IP-rich players such as Shmuel Ur Innovation, Skycure and IBM; in just 12 months, they procured around 30 US patents for IBM based on inventions in Israeli labs. “Glazberg is not just a top-notch patent attorney; he also really understands computers, which makes a big difference. He brings excellent domain knowledge to the table, is extremely smart, quickly grasps the issues at hand and is fun to work with.” Applebaum is a “veteran litigator who ably devises pre-trial strategies”.
Gilat, Bareket & Co, Reinhold Cohn Group

Reinhold Cohn Group is a titan of the Israeli IP scene, combining the talents of patent attorney firm Reinhold Cohn & Partners and law firm Gilat, Bareket & Co in a potent A-to-Z offering. Intimately familiar with the local landscape, it has also been expanding its expertise in emerging markets, especially China, India and Brazil. On the non-contentious front, it has recently been assisting Israel Aerospace Industries on its Iron Dome project, a sophisticated mobile all-weather air defence system; while representation of Abbvie was a recent contentious highlight. Co-leading the technology department is design patent maven David de Vries. On speed dial for a raft of private and military organisations, he nimbly shepherds start-ups through the patent maze, as exemplified by his work for DAFNI, established by Forbes 2016-listed entrepreneur Sharon Rabi. Ehud Hausman leverages on his background as a software engineer to provide thought leadership in the high-tech space. Maintaining a broad IP practice, mechanical engineer Ena Pugatsch has a particular facility for oppositions, where her strategic nous often proves invaluable; she has recently been working alongside Hausman for Israel Aerospace Industries. Life sciences and chemistry are the metiers of Ilan Cohn, a trusted guide for companies which have trained their attentions eastwards, not least thanks to solid ties with China’s State IP Office. Organic chemistry and nanotechnology guru Ronnie Benshafrut is an authority on patent term extensions, a subject on which he has written extensively; while physicist Svetlana Stadler counts semiconductor issues as a forte. For transactional matters, businesses seek out co-founder Daphna Gilat, a dab hand at getting lucrative patent licensing contracts inked. The firm’s crack litigators are name partners David Gilat and Eran Bareket. Gilat lectures on patents at Tel Aviv University and has a flawless understanding of case law; while Bareket played a key role in shaping Israel’s patent legislation and was recently appointed as an IP adviser to the State Comptroller, which supervises government policies.

Herzog Fox & Neeman
Deal making comes as second nature to the IP group at Herzog Fox & Neeman, which has abundant experience helping both start-ups with going public and established operators with optimising the values of their portfolios. Many team members are foreign born or studied abroad – something which translates into a distinctly cosmopolitan ethos. Recognising that transactions often stand or fall on the tax elements, the patent practitioners collaborate closely with their teammates in the tax practice to get deals over the line. As a one-stop shop, the group has also built up notable enforcement capabilities; it has recently been representing Hazera Seeds in a ground-breaking suit hinging on interpretation of the Budapest Treaty. Of the commercially minded Karen Leslie Elburg, one client remarks: “Her professionalism, experience, responsiveness, knowledge and delivery make her amazing to work with.” The outward-looking Dan Sharot is proficient at sewing up patent licensing agreements.
H-F & Co
The IP and regulatory aspects of M&A and capital markets transactions in the technology sector are meat and drink to H-F & Co. Its hands-on, down-to-earth approach proves popular with companies of all stripes; it recently advised Adgorithms on its London Stock Exchange initial public offering and has been representing communications company Magnacom on its acquisition by Avago-Broadcom. Providing a 360-degree service, it has also been busy in the courtroom, counselling Kaiima Bio-Agritech and the founders of Waze on significant infringement matters; it has a flair for predicting how demands will be received by the other side. Recent highlights include going out to bat for Pfizer in a high-stakes dispute with a generic entity over its Viagra drug, and representing Elbit in infringement and revocation proceedings concerning night vision technology. It has also been acting for the Israeli state in a crucial case involving employee inventions. Name partner Liad Whatstein is “an extremely smart and tough litigator who has significant knowledge and experience of IP enforcement. There is no better IP lawyer in Israel”. With 25 years’ experience to his name, he has orchestrated scores of ground-breaking victories and is an authority on the life sciences.

Luthi & Co
Luthi & Co has played a pivotal role in some of Israel’s most consequential courtroom battles over pharmaceutical patents and high-tech innovations, to the benefit of myriad heavyweight players in these fields. Bayer CropScience is just one satisfied recent customer: the firm’s persuasive performance in opposition proceedings before the European Patent Office (EPO) led Syngenta to drop its challenge. The team has a wealth of in-house experience and works hand in hand with patrons; pragmatic to the last, it is forthright in identifying the innovations which are worth protection – and those which are not. “Richard Luthi is a practitioner to contact if you want a client to be well cared for,” reports one peer. “He is highly professional and pleasant to work with.” The practice head has spearheaded litigation taking place in Europe, North America, South America and Australia; an affinity for the fine print of transactions is a further string to his bow. Courtroom dynamo Daniel Lerner brings deep technical and legal know-how to the table.

More recently, it has trained its eyes further afield, strengthening ties with India, China, Europe and North America. Its forward-thinking, relatable practitioners are best known for their cost-effective prosecution output, but operate adeptly across the patent spectrum. Chemical engineering hotshot Kfir Luzzatto is a talented writer who knows how to translate abstruse legal concepts into clear and engaging prose.
