Morten Garberg is a partner of HOFFMANN EITLE’s chemistry group. He holds a master’s in chemistry from Oxford University. After graduating, Mr Garberg joined HOFFMANN EITLE’s London office. On qualifying as a chartered patent attorney and a European patent attorney, he transferred to the firm’s Munich office. He has 15 years’ professional experience with patents.
Mr Garberg spends most of his time representing clients in European Patent Office (EPO) proceedings, and has particular experience in EPO oppositions and appeals.
Mr Garberg has been involved in the coordination of multi-jurisdiction litigation, and has experience in providing litigation support, particularly in cases where there is a co-pending EPO opposition. In addition to speaking English and German, Mr Garberg is fluent in Danish and has experience providing litigation support in his native Denmark.
Although Mr Garberg has cases within a wide variety of chemical subject matter, the majority of his cases are in the pharmaceutical field. He often finds himself defending second medical use patents and formulation patents which have been opposed, frequently by multiple opponents. He has been involved in opposition cases with co-pending litigation in cases on enzymes for animal feed, polyethylene terephthalate bottles, ceramics, specialty polymers, chewing gum formulation, asthma treatment, incontinence treatment, glaucoma treatment, treatment of stomach ulcers and veterinary antibiotics.
In addition to his case work, Mr Garberg frequently presents at conferences and contributes articles to various journals and blogs, including Patents & Licensing, the American Intellectual Property Law Association’s Chemical Practice Chronicles and the Kluwer Patent blog. He often travels to the United States and Scandinavia, where the majority of his clients are based.
