Robert J Goldman’s practice centres on trials and appeals in complex IP matters. He has tried patent, copyright and trade secret cases in technologies ranging from pharmaceuticals to medical devices to computer hardware and software to imaging systems.

Mr Goldman has taught patents and patent litigation as an adjunct instructor at Stanford and Fordham Universities. He is the co-author of Patent Law & Practice (eighth edition, BNA 2015), a standard reference work for US courts and practitioners. Representative clients and matters include the following:

  • Regeneron Pharm, Inc v Ablexis LLC (for Ablexis) – bench trial on claim construction and indefiniteness, resulting in findings of indefiniteness and dismissal of all infringement claims.
  • In re OxyContin Antitrust Litigation (for Purdue Pharma, LP) – three bench trials, totalling 20 days, on seven patents relating to abuse-deterrent controlled-release pain medication. Settlements reached with four groups of defendants. Four patents found infringed but invalid, now on appeal.
  • OPTi, Inc v Advanced Micro Devices, Inc (for Advanced Micro Devices) – five-day jury trial on OPTi patent relating to core-logic chipsets. Action settled during trial before verdict.
  • In re OxyContin Antitrust Litigation (for Purdue Pharma, LP) – bench trial adjudication that three Purdue patents were enforceable.
  • Samsung v Tessera (for Tessera) – eight-day jury trial on Tessera patents relating to semiconductor packaging. Action settled during trial before verdict.
  • Compaq Computer Corp v eMachines – summary judgment of infringement of nine patents relating to personal computer sub-systems. Obtained permanent injunction before trial against further infringement of two patents. Damages claim in excess of $200 million before trebling. Settled through mediation two weeks before trial.
  • Purdue Pharma, LP v Boehringer Ingelheim, GmbH – four-day bench trial on motion for preliminary injunction. Injunction granted and affirmed on appeal.
  • Polaroid Corp v Eastman Kodak Co – 75-day bench trial on liability. Ninety-six-day bench trial on damages. Judgment for Polaroid, including permanent injunction, damages of $873 million.
