These operate under a single leadership team, headed by senior partners with the respective expertise.
WAN HUI DA is a leading supplier of a full range of IP law services in China, from registration of patents and trademarks to litigation of patents, technology disputes, trademarks, unfair competition and other IP-related matters. Over the years, our prosecution team has helped clients to prosecute numerous patent and trademark applications and obtain enforceable patent and trademark rights with a high rate of success. We have litigated hundreds of cases concerning patent infringement and validity, trademark registration, ownership and infringement, unfair competition, trade secrets infringement, patent ownership and other disputes related to technology and intellectual property, protecting and defending our clients’ interests and helping to advance China’s legal fronts. We also advise our clients over IP strategy, patent clearance and validity assessment, due diligence and counselling of all IP matters. As always, we focus on adding value to our clients.
In the patent area, we have 150 professionals with experience in patent litigation, prosecution and counselling. Many have more than 10 years’ litigation experience. Some have experience working for Chinese courts, the China Patent Office and the Patent Re-examination Board, and some have experience working for industries and research institutions before joining private practice. These diverse backgrounds strengthen our understanding of our clients and the Chinese system, to deliver services to our clients effectively. Our licensed patent attorneys cover all technical fields. Most of them have advanced technical educations and obtained their doctorate and master’s degrees in the best universities in China. Our expertise is particularly robust in chemical, pharmaceutical and biotech areas. In these areas, six senior patent partners have advanced degrees and have worked on complex matters for clients. Some of our professionals have received education and work experience from outside China, including the United States, Europe and Japan.
We are at the leading edge of patent litigation. We have abundant experience in litigating patent and technology matters at all levels of court up to the Supreme People’s Court. Our patent litigation service also covers validity and re-examination disputes before the Patent Re-examination Board and their subsequent administrative litigation. Some of our cases involve parallel litigations in China as well as in other jurisdictions. Many of our cases are recognised as groundbreaking, as we not only creatively protect the interests of our clients, but also help to advance the IP legal frontier. We have had more than 20 cases included in the Supreme People’s Court Gazette or selected in the top 50 IP rights cases in China. Besides judicial remedial approach, we are also experienced in administrative enforcement, working with government bodies such as local IP offices, the Administration of Industry and Commerce, Customs and the food and drug regulatory authorities.
Besides working on client matters, WAN HUI DA also participates in China’s development of patent and technology laws. We have established a strategic cooperation partnership with a Beijing-based non-profit organisation, the Intellectual Property Right Centre (IPRC). The IPRC comprises some of China’s leading experts in patent and technology laws, as well as other related laws. It studies cutting-edge legal issues and publishes various reports addressing these issues. The IPRC’s experts frequently participate in ongoing discussions with courts, legislature and various agencies on major issues concerning IP rights. Our work with the IPRC provides a useful channel for our professionals to participate in the development of Chinese law and to gain insight into cutting-edge legal issues.
