With more than 200 attorneys, Winston & Strawn LLP’s IP practice is one of the most active and highly regarded in the United States. In January 2014 Winston was the most honoured litigation group in The American Lawyer’s biennial Litigation Department of the Year review. As in 2010, we were selected as one of four finalists for IP Department of the Year (one of only six firms to be honoured more than once). That same year, our litigation practice co-chair was selected as one of the six Litigators of the Year, and our general litigation practice was selected for honourable mention (the fourth time Winston has been honoured in this category). Our IP practice is continually recognised in leading patent and trademark publications. In 2016 Winston was one of only 21 firms recommended in the national patent litigation category of the IAM Patent 1000, which also listed 19 partners as leaders in patent law. The IAM Patent 1000 stated that the 180-plus attorneys comprising Winston’s patent infringement team boast “impressively muscular contentious capabilities” and that the firm “towers over the national patent litigation scene”. In addition, the firm and six partners were named among the world’s leading trademark attorney firms and practitioners for the sixth consecutive year in the WTR 1000 2016.

In addition, a large number of other publications have recognised our practice. For example, The National Law Journal selected Winston’s Chicago office as the 2016 Chicago IP Department of the Year. In 2016 our IP litigation practice was ranked in the first tier nationally for the fifth consecutive year by U.S. News & World Report in its Best Law Firms survey.

Consistent with these group rankings, our individual IP attorneys are routinely recognised as leaders in the field. More than one-third of our patent litigation partners have been recognised in publications such as ChambersBest Lawyers in AmericaLawdragonLegal 500 and Super Lawyers.

Additional statistics about our patent litigation practice include the following:

  • Nearly 80 of our attorneys have technical degrees and nearly 40 are members of the Patent Bar.
  • More than 30 of our partners have first-chaired IP trials in various courts throughout the United States and Europe.
  • Over the past five years, our attorneys have handled more than 500 IP cases in 31 states.
  • Over the past five years, our attorneys have appeared in more than 80 IP-related appeals.
  • Our International Trade Commission group has collectively appeared in more than 70 Section 337 International Trade Commission investigations.
  • We were listed as the top defence firm in Lex Machina’s Hatch-Waxman/ANDA Litigation Report 2015, having defended more abbreviated new drug application cases (151) than any other firm between 2009 and 2015.

In addition, Winston has an active patent prosecution practice that assists clients with the prosecution, development, maintenance and licensing of patent portfolios worldwide. Our patent prosecution attorneys typically file 200 to 300 US patent applications and obtain approximately 150 US patents annually. The firm’s scientifically trained attorneys and patent agents are experienced in the preparation and worldwide prosecution of patent applications pertaining to the traditional sciences, as well as in new and developing technologies. All of our patent attorneys have technical degrees in fields such as electrics, mechanics, computers, chemical, materials, general engineering, biology, medicinal chemistry and metallurgy.
