Andrew Thomases is co-head of Ropes & Gray LLP’s technology, media and telecommunications practice group and a nationally recognised first-chair trial lawyer. He has over 20 years’ experience litigating complex patent and trade secret cases in federal courts throughout the country and before the US International Trade Commission (ITC). He has achieved numerous successes for clients in all areas of technology, including computer technology, semiconductors, analogue circuits, wireless technology, software, medical devices and life sciences. He is a member of the Patent Bar and has significant experience before the Patent Trial and Appeal Board.
His first-chair trial experience includes representing Spansion in the biggest flash memory patent war of 2014 and 2015 against major competitor Macronix International Co, Ltd. His representation of Spansion included four investigations before the ITC, three district court actions in the Eastern District of Virginia and the Northern District of California, and 11 inter partes review proceedings before the US Patent and Trademark Office (USPTO). Throughout this patent war, Mr Thomases and his team achieved numerous successes, including a high-profile decision dismissing Macronix’s patent complaint and setting a new standard for pleading patent infringement. His team also conducted two patent trials before the ITC, both enforcing Spansion’s patents and defending Spansion from Macronix’s patents. While the decisions in those cases were pending, Mr Thomases obtained an order from the ITC’s chief administrative law judge sanctioning Macronix for its discovery misconduct. The team also defeated several attempts to put Spansion’s patent claims into inter partes review before the USPTO. Other significant achievements include his role in obtaining a $57 million-plus jury verdict on behalf of Medtronic – one of the largest plaintiff verdicts in California in 2009.
He is recognised as a Leading Lawyer in patent litigation by Chambers USA, has been named a Top IP Litigator in California by the Daily Journal, is ranked by Legal 500 for his record of successfully representing clients before the ITC and is listed as a Super Lawyer for Northern California.
